Applicant and Candidate Privacy Policy
Husky (“us” or “we”) is committed to protecting the privacy and security of candidates’ personal data (i.e. data by which you may be directly or indirectly identified, the Personal Data). This privacy notice describes how we collect and use Personal Data about you during and after the recruitment process in accordance with applicable Privacy laws.
More specifically, Husky as Data Controller will:
- comply with relevant data protection legislation and all other applicable laws;
- only collect Personal Data that may be required as part of the recruitment process;
- make sure you can access and exercise your other rights under relevant applicable data protection legislation; and
- protect your Personal Data and keep it secure.
You are under no statutory or contractual obligation to provide Personal Data to Husky during the recruitment process. However, if you do not provide the information, we may not be able to process your application properly or at all. In accordance with applicable laws, Husky may use automated decision-making tools or technologies based on artificial intelligence as part of the recruitment process, see section “Is your Personal Data used in automated decision making?”.
The types of personal information we may collect and process about you
Personal Data means any information about an individual from which that person can be identified. The categories of Personal Data we may collect and hold about you may include:
- Personal contact details such as name, surname, title, addresses, telephone numbers, and personal email addresses;
- Personal details such as date of birth, gender and nationality;
- CV’s or cover letters or any other supplementary document included as part of the application process where requested or not;
- Information about your right to work in a specific country;
- Information regarding your work history, qualifications, professional memberships, education, experience, or employment references; and
- Photographs if included on CVs or otherwise on supplementary documents submitted as part of the recruitment process;
We may also collect, store and use the following special categories of more sensitive Personal Data, which could include:
- Information about whether you have a disability for which we need to make reasonable accommodations as part of the recruitment process; and
- Information about criminal convictions and offences (where the nature of the job requires this).
How is your Personal Data collected?
We may collect this information in a two different ways.
- Directly from you, for example data might be collected through application forms; your CV; from correspondence with you; or through interviews, meetings, or other assessments; or
- From third parties, such as references supplied by former employers or recruitment agencies, in accordance with applicable laws, and information from criminal records checks to the extent permitted by law.
Where is your Personal Data stored?
Your Personal Data will be stored in a range of different places, including but not limited in our recruitment files, on our HR platform, and in other IT systems (including our email system).
Why is your Personal Data processed?
Under applicable privacy laws, Husky only collects your Personal Data if it has a valid purpose for doing so. The purposes for which Husky processes your Personal Data is in order to take steps to enter into a contract with you and will retain that Personal Data in order to perform that contract. Moreover, Husky has a legitimate interest in processing Personal Data during the recruitment process and for keeping records of the process. We may also need to process data from job applicants to respond to and defend against legal claims. In some cases, we need to process data to ensure that we are complying with our legal obligations such as compliance with laws regarding eligibility of employment in a specific country. We may process health information where required or permitted by applicable law if we need to make reasonable accommodations to the recruitment process for candidates who have a disability. Where we need to process other special categories of data, such as information about ethnic origin, sexual orientation, or disability, this is for equal opportunities monitoring purposes as permitted by applicable local laws. For some roles, the organization is eligible to seek information about criminal convictions and offences where permitted by applicable law. Where it is necessary to collect and process any special categories of sensitive Personal Data, we will ensure it is handled with the utmost discretion and will limit access to the information to the individuals who require it for the purposes of which it is being requested / processed. Finally, we may process your Personal Data using our AI-assisted features as part of our decision-making process.
Who has access to your Personal Data?
Your information will be shared internally for the purposes of the recruitment exercise. This includes members of the human resources team, relevant hiring managers (or team leaders) interviewers involved in the recruitment process, and IT staff if access to the data is necessary for the performance of their roles. Husky may share your Personal Data with authorized third parties that have been engaged by Husky such as professional advisors, external consultants, and recruitment agencies. To ensure that your personal information does receive an adequate level of protection we have put in place appropriate measures to ensure that your personal information is treated by those third parties in a way that is consistent with and which respects applicable laws on data protection. These measures are set out below.
Where is your Personal Data transferred to?
Your data may be transferred to a different country. For instance, for applicants that reside within the European Economic Area (“EEA”), Personal Data may be transferred outside the EEA with hiring managers or those participating in recruitment and selection processes.
Personal data may be transferred to the following countries located outside of the EEA: Canada (which benefits from an adequacy decision issued by the European Commission),
Switzerland, which benefits from an adequacy decision issued by the European Commission;
United States of America (USA), where transfers are carried out on the basis of appropriate safeguards, such as:
an adequacy decision adopted by the European Commission (e.g. participation in the EU–US Data Privacy Framework, where applicable); and/or
the use of Standard Contractual Clauses (SCCs) adopted by the European Commission, together with any supplementary measures required under applicable data protection law.
Certain countries in which recipients and data processors may be located and to which Personal Data may be transferred may not have the same level of protection of Personal Data as the one afforded in the EEA. Personal data transferred to countries outside of the EEA will be protected by appropriate safeguards such as standard contractual clauses approved by the European Commission and you may obtain a copy of such safeguards by contacting the relevant Husky Privacy Officer listed below.
Is your Personal Data secure?
We take the security of your data very seriously. We have internal policies and controls in place to try to ensure that your data is not lost, accidentally destroyed, misused or disclosed, and is not accessed except by its employees in the performance of their duties.
Where we engage third parties to process Personal Data on our behalf or we share Personal Data with third parties, those third parties do so on the basis of our instructions, are under a duty of confidentiality and are obliged to implement appropriate technical and organizational measures to ensure the security of data.
How long is your Personal Data retain for?
We will not hold your Personal Data longer than we need it. If unsuccessful, generally we keep the majority of your information for 24 months, unless otherwise required by applicable laws. If you are successful in your application, information collected as part of the recruitment process will be transferred to your personnel file and retained during your employment and for the necessary retention period after the end if your employment, in accordance with Husky’s Retention Policy.
Is your Personal Data used in automated decision making?
In accordance with applicable laws, Husky may use automated decision‑making tools or technologies based on artificial intelligence (AI Tools) as part of the recruitment process:
- The AI Tools may assist with tasks such as initial application screening, skills‑matching, or identifying candidates whose profiles align with job‑related requirements. AI tools help for triage large application volumes by highlighting potential matches to the role criteria (e.g., skills/experience alignment). Scores can also be refreshed as your application progresses).
- Where AI Tools are used, they may influence the order in which applications are reviewed or which candidates are prioritized for further assessment. However, AI Tools do not determine outcomes independently and are not used to make decisions without meaningful human involvement. All applications are subject to human review, and the reviewer retains full discretion to disregard or override any score or recommendation generated by such tools. Husky conducts regular testing to identify potential bias or errors in the operation of AI Tools and reserve the right to suspend or discontinue use of any tool where material issues are identified.
- Under certain circumstances and in compliance with applicable laws, candidates may retain all rights provided under applicable privacy laws, including the right to request human intervention, express their views, and contest decisions made with the assistance of automated systems (further information under “your rights”
What data is used and information about the decisions made by the AI Tools
The AI Tools compare the stated job requirements against information you provide, including your CV or résumé, work history, skills, and educational background, together with any other information submitted as part of your application. We do not instruct the AI Tools to process special category data as defined under applicable privacy laws, such as but not limited to data related o racial or ethnic origin, health data, political opinions etc..
The AI Tools use generative and adaptive techniques to assess textual and structured information in your application against stated job criteria and outputs four sub‑ratings (e.g., skills, experience, education, profile) and an overall match indicator. Scores are shown on a 0–5 scale and may be accompanied by a brief, model‑generated summary of the factors that influenced each score. Configuration determines when scores are calculated (e.g., on application or at a defined stage).
Your rights
Under certain circumstances and in accordance with applicable laws, you may have the following rights :
- Right of access – you may have the right to request a copy of the Personal Data we have on you and to request supporting information explaining how the Personal Data is used.
- Right of rectification – you may have the right to request that we correct inaccurate Personal Data about you.
- Right of erasure – you may have the right to request that we erase all Personal Data about you (please note that we may be able to reject or restrict the request in some circumstances, depending on the information we hold and our lawful reason to keep it).
- Right to restrict processing – in some situations, you may have the right to request that we do not use the Personal Data you have provided (e.g. if you believe it to be inaccurate).
- Right to object – you may have the right to object to certain processing of your Personal Data (unless we have overriding compelling grounds to continue processing).
- Right to data portability – you may have the right to request the transfer of your Personal Data to another party.
I to our optional AI‑assisted recruiting system, in accordance with applicable privacy laws your rights may also include:
- Right to human intervention & contest – you may have the right to obtain human intervention in relation to any artificial intelligence influenced assessment, express your point of view and ask that a person review your application without using the outcome generated by the AI Tool.
- Right to obtain an explanation - you may have the right to obtain information on how AI Tool was used in your case (including the main factors the model considered) and challenge the outcome.
- Right to object – you may have the right to restrict the processing or object to it, even if you initially consented.

If you believe that Husky has not complied with your data protection rights, you can lodge a complaint with the relevant National Authorities. In Europe, for example, you may contact the Luxembourg data protection authority where Husky operates, or any other European data protection authority (e.g. in your country of residence).
